Pawnbrokers and second-hand dealers orders

List of orders NCAT can make under the Pawnbrokers and Second-hand Dealers Act 1996 (NSW).

If you are applying to NCAT you must quote the section of the Act that you issue falls under. Write the section number in the orders section of the application form.

Please also provide full details about why you are applying to NCAT and what you are claiming (e.g. money compensation, retention of goods). 

If you have received a notice of hearing, the section numbers may help you understand why you have been taken to NCAT and the types of supporting documents you should gather.
   

A pawnbroker or second-hand dealers application to NCAT must be made within 28 days from the date the Restoration Notice was served on the licensee.

Section Orders Who can apply?
32G(3)(a)

An order for the delivery of goods to the rightful owner

Licensee

32G(3)(b)

An order with respect to the goods where the rightful owner cannot be ascertained or located

Licensee

32G(3)(c)

An order for the delivery of the goods to the licensee

Licensee

32G(4)(a)

An order for the delivery of goods to the rightful owner, but giving the licensee the option of retaining the goods and paying that person the value of the goods

32G(4)(b)

An order for payment of the assessed value of the goods to the rightful owner

Licensee

32G(7)

An order for payment as compensation or otherwise to or by the licensee.
