Privacy Awareness Week NSW 2026 runs from 4–10 May 2026. This year’s theme, Smart Tech, Smarter Choices – Protecting Yourself in the Age of AI, is a reminder to think carefully about how personal information is used and shared when using generative artificial intelligence (Gen AI).
To assist parties and their representatives, NCAT has issued guidance on the acceptable use of Gen AI in Tribunal proceedings:
Gen AI tools can assist with tasks such as organising information, summarising material or preparing chronologies. However, they may also create privacy risks if personal, sensitive or confidential information is entered into them.
This guidance sets out when Gen AI may be used to assist with Tribunal-related tasks, while reinforcing the need to protect personal and confidential information.
Anyone involved in NCAT proceedings is encouraged to review these resources before using Gen AI.
Gen AI must not be used to generate or alter evidence in Tribunal proceedings, including statements, affidavits, statutory declarations or other evidentiary material.
It also must not be used to generate content for an expert report unless the Tribunal has given permission.
